Welcome to Cascade CBX (“Cascade,” “we,” “us,” “our”). We operate this website and store (the “Services”) to offer a curated shopping experience powered by Shopify. These Terms of Service (the “Terms”) govern your use of the Services and incorporate any policies referenced here (including our Privacy Policy (https://cascadecbxsport.com/policies/privacy-policy) and Refund Policy (https://cascadecbxsport.com/policies/refund-policy).
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. ACCESS & ACCOUNT

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into these Terms. You are responsible for the accuracy of information you provide and for keeping your login credentials secure. You may not transfer or sell your account.

2. OUR PRODUCTS (TOPICALS ONLY; NO MEDICAL CLAIMS)

We offer non-ingestible, hemp-derived topicals only. Color/appearance may vary by device settings. We do not promise that any product will meet your expectations or perform identically to images. Descriptions, pricing, and availability may change without notice; quantities may be limited per person or region.
FDA Notice: Our products and content are not intended to diagnose, treat, cure, or prevent any disease and are not medical advice. Consult a healthcare professional before use, especially if pregnant, nursing, or under care for a medical condition.

3. ORDERS

Your order is an offer; we may accept or decline in our discretion. Orders are accepted when payment is processed and we send confirmation. Cancellations may be unavailable after acceptance. Purchases are for personal/household use only (no resale). Returns/exchanges are governed by our Refund Policy (https://cascadecbxsport.com/policies/refund-policy).

4. PRICES & BILLING

Prices may change without notice. Unless stated otherwise, prices exclude taxes, shipping, duties, and fees. You agree to provide current, accurate billing details and authorize us (or our processor) to charge your payment method for the total amount due.

5. SHIPPING & DELIVERY; RISK OF LOSS

Delivery windows are estimates and not guarantees. We are not responsible for carrier delays or events outside our control. Title and risk of loss pass to you upon our delivery to the carrier.

6. INTELLECTUAL PROPERTY

All content, trademarks, and materials on the Services are owned by Cascade CBX or its licensors and protected by law. You may use the Services only for personal, non-commercial use. No license is granted except as expressly stated.

7. OPTIONAL TOOLS & NEW FEATURES

Third-party tools/features may be provided as-is without warranties. Your use is at your own risk and subject to the third party’s terms.

8. THIRD-PARTY LINKS

Linked sites are not controlled by us. We are not responsible for their content, policies, or products. Review third-party terms before transacting.

9. RELATIONSHIP WITH SHOPIFY

The Services are hosted by Shopify. Your sale is with Cascade CBX, not Shopify. You expressly release Shopify from claims arising from your purchases from Cascade CBX.

10. PRIVACY

Your use of the Services is subject to our [Privacy Policy][LINK]. Because we use Shopify, some data is processed by Shopify and its partners—see Shopify’s privacy disclosures for details.

11. FEEDBACK & REVIEWS

By submitting reviews, ideas, or suggestions (“Feedback”), you grant Cascade CBX a perpetual, worldwide, royalty-free license to use and display the Feedback. You represent you have the right to submit it and that it complies with these Terms and applicable law. We may moderate or remove Feedback at our discretion.

12. ERRORS & CORRECTIONS

We may correct any errors or omissions and change or update information (including after order submission) without notice.

13. PROHIBITED USES

You agree not to use the Services unlawfully; infringe IP; harass or abuse others; introduce malware; scrape or spider; circumvent security; misrepresent identity; or otherwise interfere with normal operation. We may suspend or terminate access for violations.

14. TERMINATION

We may suspend or terminate the Services or your access at any time. Sections intended to survive (including IP, Feedback, Disclaimers, Liability limits, Indemnity, Governing Law) will survive.

15. HEALTH / COMPLIANCE DISCLAIMERS

• Drug-testing: Our topicals are non-ingestible and formulated without THC; however, we do not guarantee the outcome of any drug test, as testing protocols and individual circumstances vary.

• Use directions: Follow label directions. Discontinue use if irritation occurs. Keep out of reach of children.

• Regulatory: Products are lawful hemp-derived cosmetics/topicals as defined by applicable law where offered for sale.

16. DISCLAIMER OF WARRANTIES

EXCEPT AS REQUIRED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, timely, secure, or error-free operation.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, CASCADE CBX (AND ITS OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, AND LICENSORS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUE; OR LOSS OF DATA/GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. Our aggregate liability to you for direct damages will not exceed the amount you paid to us for the product(s) giving rise to the claim in the 12 months preceding the claim.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Cascade CBX and its affiliates from claims and expenses arising from your breach of these Terms or your misuse of the Services or products.

19. SEVERABILITY

If any provision is unlawful or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remainder will continue in full force.

20. WAIVER; ENTIRE AGREEMENT

Our failure to enforce a provision is not a waiver. These Terms (plus linked policies) are the entire agreement between you and Cascade CBX regarding the Services.

21. ASSIGNMENT

You may not assign these Terms without our written consent. We may assign them without notice.

22. GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of Minnesota without regard to conflicts of law. You consent to exclusive jurisdiction and venue in the state and federal courts located in Hennepin County, Minnesota.

Informal Dispute Resolution & Arbitration. Before filing a claim, the parties will first try to resolve it informally within 30 days after written notice. Except for small-claims and injunctive relief, disputes will be resolved by binding arbitration on an individual basis, and class actions are waived. (If you want this, I can drop in a full AAA/JAMS clause.)

24. CHANGES TO TERMS

We may update these Terms from time to time. We’ll post the updated Terms with a new “Last updated” date. Material changes will be notified as required by law. Your continued use after changes means acceptance.
